It depends on the language in the lease. My lease has that in the event the tenant wants to move out earlier they would owe half of what is due on the lease and lose deposit. If this or something like this is clearly outlined in lease you could take them to court to recover missed income. It might be best to contact the tenant and try to work out a deal. IE I won't take you to court if you pay x amount.
